Development of the film began in 2008, and by late 2009 Lee Daniels began negotiations to direct. However, in the summer Daniels left the project to film "The Butler".
Until July 2013, the project was on hold, until Ava DuVernay signed on to direct it after rewriting the screenplay with its original author, Paul Webb.
David Oyelowo was the only actor to carry over from the planned 2010 project to the 2014 project. Robert De Niro, Hugh Jackman, Cedric "The Entertainer", Lenny Kravitz, and Liam Neeson, who were cast in 2010, left the project.
Principal photography began on May 20, 2014, in Atlanta, Georgia, while filming in Selma, Alabama was scheduled for June 23-26.

It turned out that the heirs of Martin Luther King Jr. have already sold the rights to use King's speeches in defense of human rights to the film companies "DreamWorks" and "Warner Brothers" for use in a future biopic. For this film, director Ava DuVernay wrote new versions of these King speeches.
